(1) Notwithstanding
the vesting of the undertakings of the existing banks in the Bank under and in
terms of this Act, sections 89 to 95 inclusive of the Evidence Act 1906
continue to apply with respect to the bankers’ books of the existing
banks that are transferred to the Bank by virtue of this Act as if those
bankers’ books were bankers’ books used in the ordinary business
of the Bank.
(2) In subsection (1)
bankers’ books means ledgers, day books, cash books, account books, and
all other books and records used in the ordinary business of an existing bank
before the appointed day.
