In the absence of
proof to the contrary, if a statement is made in a prosecution notice or an
indictment containing a charge of an offence against this Act —
(a) that
a person therein referred to is or is not a person of Aboriginal descent; or
(b) that
the proceedings are commenced in accordance with a direction of, or under the
authority of, the CEO; or
(c) that
a place or area therein referred to is within the boundaries of any land to
which the provisions of Part III apply,
all courts and persons
acting judicially shall presume the statement proved.
