BAIL ACT 1982 - SECT 51A

51A .         Prosecuting s. 51 offence for non-appearance in court of summary jurisdiction

        (1)         This section applies for the purpose of prosecuting an offence against section 51(1), (2) or (2a) where the court before which the accused is bound to appear at the time when the accused fails to comply with the accused’s bail undertaking is a court of summary jurisdiction.

        (2)         Where this section applies, the prosecution shall be commenced and conducted by the person who was conducting the proceedings in which the accused failed to comply with the accused’s bail undertaking or by a police officer.

        (3)         Where this section applies, the registrar of the court before which the accused was bound to appear shall cause to be issued to the Commissioner of Police a certificate under section 64 as to the accused’s failure to appear.
