BAIL ACT 1982 - SECT 7E

7E .         Bail refused for trial, court’s duty during trial

        (1)         Where —

            (a)         an accused has been refused bail for the accused’s appearance for trial for an offence; and

            (b)         the trial extends beyond one day,

                a judicial officer referred to in section 7(1) need not comply with that subsection unless the accused, or a person on the accused’s behalf, applies for bail.

        (2)         In subsection (1) —

        trial means that part of proceedings for an offence when evidence is being received by the court in respect of the offence and also extends to any time when —

            (a)         legal argument is being heard; or

            (b)         a judicial officer or a jury is deliberating.
