(1) In this section
—
party wall work consent means —
(a) a
consent in writing of the adjoining owner as mentioned in section 387(1) of
the former provisions; or
(b) the
expression of the adjoining owner’s agreement to comply with the
requirements of a party wall notice given under section 387(1) of the former
provisions,
that was given or made during the period of 6
months before commencement day.
(2) A party wall work
consent is, on and from commencement day, to be taken to be a consent for the
purposes of sections 79(1)(a) and 81(2)(a) given on condition that the
building owner complies with any requisition made under section 386 of the
former provisions to the extent that compliance was required under that
section 386.
(3) Despite the
Interpretation Act 1984 section 37(1), sections 393, 394 and 395 of the former
provisions do not apply in relation to work completed on or after commencement
day, in which case sections 89 and 90 apply.
