(1) If the State is a
permit authority for a building or an incidental structure it may, by
instrument in writing, designate a public service officer as an authorised
person for the purposes of this Act in relation to the building or incidental
structure.
(2) If a special
permit authority is a permit authority for a building or an incidental
structure it may, by instrument in writing, designate an employee of the
special permit authority, or an employee of one of the legal entities that
comprise the special permit authority, as an authorised person for the
purposes of this Act in relation to the building or incidental structure.
(3) A local government
may, by instrument in writing, designate a person employed by the local
government under the Local Government Act 1995 section 5.36, as an authorised
person for the purposes of this Act in relation to buildings and incidental
structures located, or proposed to be located, in the district of the local
government.
(4) The regulations
may limit to persons belonging to prescribed classes of public service
officers or employees the persons who may be designated as authorised persons
under subsection (1), (2) or (3).
(5) A person may be
designated to be an authorised person for a fixed or indefinite period.
(6) A permit authority
may, by instrument in writing, revoke a designation at any time.
