(1) A plant that is a
declared pest as that term is defined by the
Biosecurity and Agriculture Management Act 2007 , or the refuse of such a
plant, may be burnt during the prohibited burning times so long as the burning
is carried out subject to and in accordance with the regulations.
(2) A person who,
pursuant to the authority of this section, burns a plant or the refuse of a
plant and fails to carry out the burning in accordance with the regulations is
guilty of an offence against this Act.
Penalty: A fine not exceeding $2 000.
