(1) Except as
otherwise expressly provided in this Act, nothing in this Act and no
conviction, payment of penalty or proceeding taken under this Act takes away
or affects any right of action or other remedy at common law or otherwise
which a person may have in respect of loss or damage caused by a bush fire to
which this Act relates.
(2) It is not a
defence to a claim for damage, loss or injury in respect of the doing of
anything, that it was done by or pursuant to the authority of this Act.
(3) The provisions of
the last preceding subsection do not prejudice or affect those of section 37
of the FES Act.
