(1) Any decision of
the former Tribunal, whether made before commencement day or in accordance
with section 134 —
(a) that
would have been reviewable by the State Administrative Tribunal had the law in
force immediately before commencement day continued to apply; or
(b) in
respect of which an application for review had been made to the State
Administrative Tribunal but not determined,
is to continue to be
dealt with as if the repealed Act as in force before commencement day and the
Home Building Contracts Act 1991 as in force immediately before the coming
into operation of Division 1 had continued to apply.
(2) On and from
commencement day anything ordered, decided or otherwise done by the former
Tribunal in the performance of a function of the former Tribunal, whether
before commencement day or in accordance with section 134, remains or is of
the same effect as if, and is enforceable as if, the repealed Act as in force
before commencement day and the Home Building Contracts Act 1991 as in force
immediately before the coming into operation of Division 1 had continued to
apply.
