(1) If an authorised
person suspects on reasonable grounds —
(a) that
a dangerous situation exists; and
(b) that
immediate measures are needed in order to identify, assess, reduce, eliminate
or avert the risk to people, property or the environment from the building
services involved in the situation,
the authorised person
may take the necessary measures.
(2) For the purposes
of subsection (1), an authorised person may do any or all of the following
—
(a)
enter and take possession of a place;
(b)
isolate the place under section 78;
(c) take
any other action that is necessary and incidental.
(3) An authorised
person’s powers under this section are in addition to the other powers
of the authorised person under this Act and may be exercised whether or not a
remediation notice has been given to any person.
(4) An authorised
person must not exercise a power under this section if a like power is already
being exercised under another written law.
