(1) If a remediation
notice has been given to a person and the person has not complied with it, an
authorised person may take the measures specified in the notice.
(2) For the purposes
of subsection (1) an authorised person may —
(a)
enter and take possession of a place; and
(b) take
any other action that is reasonably necessary and incidental.
(3) An authorised
person’s powers under this section are in addition to the other powers
of the authorised person under this Act.
(4) The Building
Commissioner may recover the reasonable costs and expenses incurred in taking
measures for the purposes of subsection (1) in a court of competent
jurisdiction as a debt due from the person to whom the remediation notice was
given.
(5) In a proceeding
under subsection (4), a document apparently signed by the Building
Commissioner specifying details of the reasonable costs and expenses incurred
is, in the absence of evidence to the contrary, proof of the details
specified.
