(1) The Minister is
required, by notice published in the Gazette , to designate a person who is an
executive officer of the Department as the Commissioner for the purposes of
the cognate Acts.
(2) The Commissioner
may be referred to by a title specified by the Minister by notice published in
the Gazette .
(3) Without limiting
any other functions of the Commissioner for the purposes of the cognate Acts,
the Commissioner has the following functions —
(a) to
investigate and conduct research into matters relating to the cognate Acts;
(b) to
publish reports and disseminate information on matters relating to the cognate
Acts;
(c) to
give advice to consumers on the provisions of the cognate Acts;
(d) to
investigate and attempt to resolve complaints arising under the cognate Acts
and to take action by negotiation, prosecution of any offence or otherwise;
(e) to
make reports to the Minister on matters of importance investigated by the
Commissioner, whether or not referred to the Commissioner by the Minister.
(4) In this section
—
executive officer has the meaning given by
section 3(1) of the Public Sector Management Act 1994 .
