(1) If a person has
contravened section 278 in relation to a co-operative, the Supreme Court may,
on the application of the co-operative or the Registrar, make any order it
considers appropriate.
(2) Without limiting
subsection (1), an order may include —
(a) a
remedial order; and
(b) for
the purpose of securing compliance with any other order made under this
section, an order directing the co-operative or any other person to do or
refrain from doing a specified act.
(3) An order may be
made whether or not the contravention continues.
(4) Proof to the
satisfaction of the Supreme Court at the hearing of an application that
—
(a) a
person has a relevant interest in a share of a co-operative because an
associate of the person has a relevant interest in a share; and
(b) the
associate became entitled to the relevant interest within 6 months before the
application was filed with the Supreme Court,
is evidence that the
associate was an associate of the person from the time the person first had
the relevant interest until the date of the hearing.
