(1) Notwithstanding
anything to the contrary contained in the Water Services Act 2012 , or in any
other Act, but subject to subsection (2), a licensee (as defined in the
Water Services Act 2012 section 3(1)) may divert, intercept, and store all
water coming from the watercourses and other sources within the boundaries of
any catchment area or water reserve, and may take any water found on or under
the land situated within any such catchment area or water reserve.
(2) A licensee shall
not exercise the powers conferred by subsection (1) in relation to water to
which section 5C of the Rights in Water and Irrigation Act 1914 applies,
except under a licence or right granted or conferred under Part III of that
Act.
