(1) When appearing at
an examination a witness may be legally represented.
(2) If the Commission
has notice that a witness will not have a legal representative present at an
examination, the Commission may, if it considers that in the circumstances it
would be in the public interest to do so, arrange for the person to be legally
represented at the examination.
(3) A witness may
decline to be legally represented as arranged under subsection (2) by the
Commission, and in that case the Commission is not obliged to arrange any
other legal representation for the witness.
(4) The Commission may
refuse to allow a witness to be represented before the Commission by a person
who is already involved in an examination or is involved or suspected to be
involved in a matter being investigated.
(5) The Commission may
allow another person to be legally represented at an examination while a
witness is giving evidence and being examined if the Commission considers
there are special circumstances.
(6) A lawyer, or any
other person, appointed by the Commission to assist the Commission may appear
before the Commission.
