(1) A person served
with a summons under section 96 requiring the person to attend and give
evidence who —
(a)
refuses or fails to be sworn or make an affirmation; or
(b)
fails to answer any question relevant to the investigation that the Commission
requires the person to answer,
is in contempt of the
Commission.
(2) Despite
sections 147(3) and 163(6), a person required by the Commission to answer a
question relevant to the investigation is not excused from the requirement to
answer the question on the ground that the answer might incriminate or tend to
incriminate the person or render the person liable to a penalty.
