(1) The Commissioner
of Police may, without giving notice to any other person, apply to the
Commission for the issue of a fortification warning notice.
(2) The Commission may
issue a fortification warning notice if satisfied on the balance of
probabilities that there are reasonable grounds for suspecting that the
premises to which it relates are —
(a)
heavily fortified; and
(b)
habitually used as a place of resort by members of a class of people a
significant number of whom may reasonably be suspected to be involved in
organised crime.
(3) The Commission may
be satisfied by a statement made by a police officer and verified by statutory
declaration.
