(1) The Minister may
give written directions to the Commissioner as to the general policy to be
followed in the performance of the Commissioner’s functions.
(2) A direction must
not be given under subsection (1) in respect of a particular matter.
(3) The Commissioner
must comply with a direction under subsection (1) unless, in the
Commissioner’s opinion, there are reasonable grounds for not complying
with the direction.
(4) If the
Commissioner refuses to comply with a direction under subsection (1), the
Commissioner must cause the reasons for his or her refusal to be included in
the report referred to in section 42.
(5) The Minister must
cause the text of a direction under subsection (1) to be laid before each
House of Parliament, or dealt with under section 61, within 14 days after the
direction is given.
(6) The text of a
direction under subsection (1) must be included in the report referred to in
section 42.
