(1) An authorised
officer must not acquire evidence of, or use, an assumed identity covered by
the officer’s authority except —
(a) in
accordance with his or her authority; and
(b) in
the course of duty.
Penalty: imprisonment for 2 years.
(2) An authorised
civilian must not acquire evidence of, or use, an assumed identity covered by
the civilian’s authority except in accordance with —
(a) the
civilian’s authority; and
(b) the
directions of the civilian’s supervisor under the authority.
Penalty: imprisonment for 2 years.
