(1) The court in which
a witness identity protection certificate is filed —
(a) must
hear the proceeding (including any application relating to the proceeding,
such as an application for an order under paragraph (b) or an application
under section 86 or 90) in closed court; and
(b) may
make any order it considers necessary or desirable to protect the true
identity of the operative for whom the certificate is given or to prevent the
disclosure of where the operative lives.
(2) A person must not
contravene an order under subsection (1)(b).
Penalty: imprisonment for 10 years.
Summary conviction penalty: a fine of $24 000 or
imprisonment for 2 years.
(3) Subsection (2)
does not limit the court’s power to punish for contempt.
