(1) This section
applies if the chief officer of a law enforcement agency gives a witness
identity protection certificate for an operative of the agency in relation to
a proceeding.
(2) The chief officer
may cancel the witness identity protection certificate if the chief officer
considers that it is no longer necessary or appropriate to prevent the
disclosure of the operative’s true identity or where the operative
lives.
(3) If the chief
officer cancels the certificate —
(a)
after it has been filed in a court and before the matter has been finalised by
the court, the chief officer must immediately give written notice to the court
and each party to the proceeding that the certificate has been cancelled; or
(b)
after it has been given to the Clerk of a House of Parliament and before the
matter has been finalised by the parliamentary committee concerned, the chief
officer must immediately give written notice to the Clerk that the certificate
has been cancelled.
