In this Part —
policy decision means a decision based
substantially on financial, economic, political or social factors or
constraints;
public body or officer means —
(a) the
Crown (within the meaning of the Crown Suits Act 1947 ); or
(b) a
department of the Public Service established under the Public Sector
Management Act 1994 section 35; or
(c) an
entity specified in column 2 of Schedule 1 to the Public Sector Management
Act 1994 ; or
(d) an
organisation specified in column 2 of Schedule 2 to the
Public Sector Management Act 1994 ; or
(e) a
non-SES organisation within the meaning of that term in the
Public Sector Management Act 1994 section 3(1); or
(f) a
local government, regional local government or regional subsidiary; or
(g) a
body that is established or continued for a public purpose under a written
law; or
(h) a
body or officer prescribed (or of a class prescribed) by the regulations as a
public body or officer to which this Part applies (in respect of all or
specified functions); or
(i)
any person or body in respect of the exercise of public
or other functions of a class prescribed by the regulations for the purposes
of this Part.
