(1) If on a court date
for an indictable charge the prosecutor does not appear, the court may —
(a)
adjourn the charge and notify the prosecutor of the new court date; or
(b)
dismiss the charge for want of prosecution.
(2) If on a court date
for an indictable charge the accused does not appear the court must either
—
(a)
adjourn the charge and either —
(i)
issue a summons to the accused that states the new court
date; or
(ii)
make an order under the Bail Act 1982 section 31(2)(b)
substituting the new court date,
as the case requires;
or
(b)
issue an arrest warrant for the accused.
(3) If an arrest
warrant is issued under subsection (2)(b) the charge is to be taken to have
been adjourned until the date when the accused next appears or is brought
before the court in relation to the charge.
