Western Australian Current Acts Western Australian Current Acts (1) This Division
applies if in a court of summary jurisdiction an accused is charged with
—
(a) an
either way charge that is to be tried summarily by the court; or
(b) a
simple offence.
(2) If under Division
5 a court proceeds in accordance with this Division, the court may
nevertheless at any time exercise a power under Division 5, and in particular
under section 55, in relation to any charge of a simple offence if the
occasion to do so arises.
