(1) The Minister may,
by order published in the Gazette , declare a specified matter or a matter of
a specified class to be a State matter for the purposes of this Act.
(2) If an agreement or
arrangement is in force under section 46, the Minister must not declare a
matter to be a State matter except in accordance with that agreement or
arrangement.
(3) An order under
subsection (1) is “subsidiary legislation” for the purposes of the
Interpretation Act 1984 and section 42 of that Act applies to and in relation
to an order as if the order were a regulation.
