(1) A person who
—
(a)
under section 9 or otherwise, obtains information connected with a disposal
referred to in section 6(1); and
(b) has
agreed or is otherwise under a duty not to disclose the information to others,
(in this section
called the bound recipient ) commits an offence if the person breaches the
agreement or the duty without lawful excuse.
(2) A person who
obtains information referred to in subsection (1) from or through the bound
recipient commits an offence if, without lawful excuse, the person discloses
the information in a way that would have resulted in a breach of an agreement
or duty if the disclosure had been by the bound recipient.
Penalty: $100 000.
