(1) Regulations may
—
(a)
prescribe any condition, or any condition of a particular class, to be a civil
penalty condition;
(b)
prescribe for a contravention of a civil penalty condition a civil penalty of
not more than $500 000 and, if the contravention is of a continuing nature, a
further civil penalty of not more than $50 000 in respect of each day or part
of a day during which the contravention has continued after the holder of the
rights that are subject to the condition was given notice that the condition
was being contravened.
(2) In subsection (1)

condition means a condition to which rights
conferred under section 34 are subject.
