(a) an
exclusive licence is granted in respect of an area in accordance with
regulations made under section 26; and
(b) the
licence is not cancelled under section 35 or surrendered,
no other person is to
be granted a licence of the same kind to have effect in respect of that area
during the period of exclusivity.
