(1) Following the
cancellation of a licence under section 35, the former licensee —
(a) must
ensure that any generating works, transmission system or distribution system
constructed or operated by the former licensee under the licence is left in a
safe condition; and
(b) is
not to remove any part of the works or system except with the approval of the
Minister.
(2) If, in the opinion
of the Minister, a former licensee contravenes subsection (1), the Minister
may cause the contravention to be rectified to the satisfaction of the
Minister.
(3) Persons authorised
by the Minister may enter any land or premises and do all things that are
necessary for the purposes of subsection (2).
(4) The Minister may
recover the costs and expenses of any action taken under subsection (2) in a
court of competent jurisdiction as a debt due by the former licensee to the
State.
