(1) The Minister must
ensure that public consultation is carried out in accordance with the
regulations before the Minister exercises the power to —
(a)
issue the AES code of practice; or
(b)
amend the AES code of practice; or
(c)
repeal and replace the AES code of practice.
(2) Subsection (1)
does not apply to an amendment to the AES code of practice if the Minister is
satisfied that the amendment is of a minor nature.
(3) Despite subsection
(1), the public consultation before the issue of the initial AES code of
practice may be carried out in the manner determined by the Minister.
