Nothing in this Part
renders it unlawful for a person to discriminate against a person with an
impairment on the ground of that person’s impairment with respect to the
terms on which an annuity, a life assurance policy, a policy of insurance
against accident or any other policy of insurance is offered to or may be
obtained by the person with the impairment where the discrimination —
(a) is
based upon actuarial or statistical data from a source on which it is
reasonable to rely or, where there is no such data, on such other data as may
be available; and
(b) is
reasonable having regard to the data, if any, and other relevant factors.
