(1) The purpose of
this section is to enable the Authority to make a decision on a matter (the
matter ) without a meeting of the Authority being held.
(2) A notice setting
out a draft decision on the matter may be sent by the Chair to each other
Authority member for consideration.
(3) The Deputy Chair
may send a notice under subsection (2) if the Chair is unable to do so for any
reason.
(4) Subject to
subsection (5), an Authority member may, by notice sent to each other
Authority member, cast a vote on whether or not the decision should be made.
(5) An Authority
member who has a direct or indirect pecuniary interest in the matter cannot
cast a vote under subsection (4).
(6) If at least 3
Authority members cast a vote under subsection (4) and a majority of the votes
are in favour of the decision being made, the decision is taken to have been
made and is as effectual as if it had been made at a meeting of the Authority.
(7) The Authority must
cause a record to be kept of each decision under subsection (6) and
section 14(2) applies to that record.
