(1) The Authority may
terminate the assessment of a proposal if —
(a) the
proponent agrees with the termination; or
(aa) the
Authority receives written notice from the proponent that the proponent does
not wish to proceed with the proposal; or
(b) the
proponent has failed to comply with —
(i)
a requirement made under section 40(2)(a) or (b); or
(ii)
section 40(6)(a); or
(iii)
a requirement made under section 40(6)(b),
within such period as
the Authority considers to be reasonable in the circumstances; or
(c) a
decision-making authority has refused to approve the proposal.
(2) Subsection (1)(c)
does not authorise the termination of the assessment if the refusal by the
decision-making authority —
(a) is
being appealed against or reviewed under an enactment; or
(b) is
capable of being appealed against or reviewed under an enactment.
