ENVIRONMENTAL PROTECTION ACT 1986 - SECT 50B

50B .         Causing material environmental harm

        (1)         A person who intentionally or with criminal negligence —

            (a)         causes material environmental harm; or

            (b)         allows material environmental harm to be caused,

                commits an offence.

        (2)         A person who —

            (a)         causes material environmental harm; or

            (b)         allows material environmental harm to be caused,

                commits an offence.

        (3)         A person charged with committing an offence against subsection (1) may be convicted of an offence against subsection (2) which is established by the evidence.
