(1) Subject to this
Act, the occupier of any prescribed premises who —
(a)
causes or increases, or permits to be caused or increased, an emission; or
(b)
alters or permits to be altered the nature of the waste, noise, odour or
electromagnetic radiation emitted,
from the prescribed
premises commits an offence unless he is the holder of a licence issued in
respect of the prescribed premises and so causes, increases, permits or alters
in accordance with any conditions to which that licence is subject.
(2) Subsection (1)
does not apply if the emission is caused, increased or altered —
(a) as a
result of anything done in accordance with a works approval; and
(b)
while the works approval is in force.
