(1) In this section
—
notice means —
(a) an
environmental protection notice; or
(b) a
vegetation conservation notice; or
(c) a
prevention notice.
(2) If —
(a) a
person bound by a notice fails to comply with it; and
(b)
damage is caused to property not owned or occupied by the person; and
(c) that
damage would not have been caused if the notice had been complied with,
then, by reason of the
person’s failure to comply, the owner or occupier of the damaged
property has a right of action in tort against the person in respect of the
damage.
