(1) A person who
acquires any information about the affairs of another person as a result of
carrying out a function under or for the purposes of this Act must not,
directly or indirectly, make a record of, or divulge or communicate the
information to a third person.
(2) However,
subsection (1) does not prohibit recording, divulging or communicating
information —
(a) in
the performance of a function under or in connection with this Act or the
Fair Trading Act 2010 ; or
(b) for
the purposes of any proceedings under this Act or the Fair Trading Act 2010 ;
or
(c) in
the course of an exchange of information with a person or body performing a
function under or in connection with a law of the Commonwealth or of another
State or a Territory, being a law that is relevant to the administration of
higher education courses in Australia.
(3) Nothing in this
section affects the operation of the Parliamentary Privileges Act 1891 .
