If, in any proceedings
for a breach of any of the provisions of this Act or of any local law relating
to lodging-houses, it is alleged that any inmates of any house or part of a
house are members of the same family, the burden of proving such allegation
shall lie on the person making it:
Provided that, for the
purposes of this section, no person shall be deemed to be a member of the
family who is not the spouse or de facto partner or a child, parent,
grand-parent, grand-child, brother or sister, nephew or niece of the occupier
of the premises.
