Western Australian Current Acts Western Australian Current Acts (1) For the purposes
of this Act, the use or disclosure of information is authorised if the
information is used or disclosed in good faith in any of the following
circumstances —
(a) for
the purpose of, or in connection with, performing a function under this or any
other Act;
(b) as
otherwise authorised or required under or for the purposes of this Act;
(c)
under another law;
(d) to a
court or other person or body acting judicially in the course of proceedings
before the court, person or body;
(e)
under an order of a court or other person or body acting judicially;
(f) any
other circumstances prescribed for the purposes of this subsection.
(2) If the use or
disclosure of information is authorised under subsection (1) —
(a) no
civil or criminal liability is incurred in respect of the use or disclosure;
and
(b) the
use or disclosure is not to be regarded as —
(i)
a breach of any duty of confidentiality or secrecy
imposed by law; or
(ii)
a breach of professional ethics or standards or any
principles of conduct applicable to a person’s employment; or
(iii)
unprofessional conduct.
