(1) If at any time
before the panel for a criminal trial is returnable the summoning officer
—
(a)
ascertains that a person on the panel to whom a summons was issued under
section 26(5) cannot be served with the summons; or
(b)
under Part VC Division 2, excuses a person on the panel who has been served
with a summons,
the officer shall
choose in rotation from the jurors whose names correspond with the numbers on
the additional tickets drawn out under section 26(2)(d) such number of persons
as is required to complete the panel and shall place their names on the panel
in substitution for the names of the persons who have not been served or who
have been excused, as the case may be.
(2) A person whose
name is so substituted shall be summoned accordingly and is bound to attend
pursuant to the summons notwithstanding that the summons was not served on the
person within the prescribed time.
