(1) A person who is
summoned may apply to be excused from the summons under section 34G, 34H, 34I
or 34J or under more than one of those sections.
(2) An application to
be excused under section 34G, 34H, 34I or 34J must be made to the summoning
officer.
(3) The summoning
officer may refer the application to a judge to decide.
(4) If the summoning
officer refuses an application to be excused under section 34G, 34H, 34I or
34J, the applicant may renew the application before a judge.
(5) The summoning
officer or judge may require an applicant to provide evidence on oath or in a
statutory declaration to substantiate the grounds on which the person seeks to
be excused.
