(1) The Second
Schedule sets out the pensions and allowances payable under this Act to and in
respect of spouses, de facto partners and children of judges and retired
judges.
(2) A person is
eligible to receive a pension or allowance under the Second Schedule whether
the circumstances or events which gave rise to the eligibility occurred
before, on, or after the date on which the Second Schedule comes into
operation.
(3) A pension is not
payable under this Act to a de facto partner of a judge or former judge who
died before the commencement of this subsection.
