(1) If an impounded
animal is ill or injured to such an extent that treating it is not practicable
the local government may humanely destroy the animal and dispose of the
carcass.
(2) A local government
must not destroy an animal under subsection (1) unless —
(a)
because of the state of the animal, destroying it is urgent; or
(b) the
local government has —
(i)
taken reasonable steps to notify the owner; and
(ii)
whether or not notice has been given under subparagraph
(i), allowed the owner a reasonable opportunity to collect the animal.
(3) Subsection (2)(b)
does not justify the destruction of an animal before it has been impounded for
at least 7 days.
