(1) A prosecution for
an offence against this Act may be commenced by —
(a) the
Departmental CEO or a person authorised by the Departmental CEO to do so; or
(b) a
person who is acting in the course of his or her duties as an employee of a
local government or a regional local government; or
(c) a
person who is authorised to do so by a local government or a regional local
government.
(2) A prosecution for
an offence against a local law may be commenced by —
(a) a
person who is acting in the course of his or her duties as an employee of the
local government or regional local government that made the local law; or
(b) a
person who is authorised to do so by the local government or regional local
government that made the local law.
