(1) On the
commencement of the winding up of an incorporated limited partnership required
on a winding up notice, the Commissioner may appoint a person to be the
liquidator of the incorporated limited partnership.
(2) The liquidator is
not required to be a registered liquidator as defined in the Corporations Act
section 9 and may be —
(a) a
general partner in the incorporated limited partnership; or
(b) an
associate of a general partner in the incorporated limited partnership.
(3) If the
Commissioner appoints a person to be the liquidator of an incorporated limited
partnership under subsection (1), the Commissioner must record the appointment
in the register.
(4) The regulations
may make provision for or in relation to the giving of security by the
liquidator to the Commissioner.
(5) The liquidator is
entitled to receive from the incorporated limited partnership property the
remuneration that is fixed by the Commissioner.
(6) Any vacancy
occurring in the office of liquidator must be filled by a person appointed by
the Commissioner.
