(1) In this section
—
convicted person means a person who has been
convicted, whether before, on or after the day on which this section comes
into operation and whether in this State or elsewhere, of an offence involving
fraud or dishonesty of a kind punishable on conviction with imprisonment for 3
months or more;
prescribed period , in relation to a convicted
person, means —
(a) the
period of 5 years after the person’s conviction; or
(b) if
the person served time in prison in respect of their conviction — the
period of 5 years after their release from prison.
(2) A convicted person
must not, except with the leave of the Commissioner —
(a) be a
general partner in a limited partnership or incorporated limited partnership
during the prescribed period; or
(b)
manage a limited partnership or manage an incorporated limited partnership
during the prescribed period.
Penalty for this subsection: a fine of $10 000 and
imprisonment for 1 year.
