No person shall enter
or remain upon the surface of any private land for any of the purposes of this
Division or those specified in section 104(1) unless he —
(a) is
the owner in occupation of that private land; or
(b) is
authorised to do so, by a permit issued under section 30, or by any other
provision of this Act, or by virtue of a mining tenement.
