(1) The Minister may,
by notice published in the Gazette , designate one or more areas of the State
for the purposes of section 57(2aa).
(2) The Minister may,
by notice published in the Gazette , vary or cancel a designation under
subsection (1).
(3) A notice under
this section comes into operation on the day on which the notice is published
in the Gazette or such later day as is specified in the notice.
(4) The variation or
cancellation of a designation under subsection (2) does not affect the
operation of any exploration licence granted before the variation or
cancellation takes effect.
(5) If —
(a) an
application for an exploration licence is made in respect of an area of land
that is in an area of the State designated under subsection (1) (a designated
area ); and
(b)
before the application is determined the designation is varied or cancelled
under subsection (2) with the result that the area of land to which the
application relates ceases to be in a designated area,
then, despite that
variation or cancellation, section 57(2aa) applies as if the area of land were
in a designated area.
