(1) In this section
—
exploration licence does not include an
exploration licence that is a primary tenement for the purposes of Division
2A.
(2) The holder of an
exploration licence may apply to the Minister for approval of retention status
under section 69B.
(3) An application
under subsection (2) —
(a)
shall be in writing; and
(b)
shall be made in the prescribed manner; and
(c)
shall contain the prescribed information; and
(d)
shall be accompanied by any map, statement or other information required by
the regulations; and
(e)
shall be accompanied by the prescribed application fee.
(4) For the purposes
of subsection (3)(d), but without limiting section 162(5), the regulations may
require a statement or other information to be in the form of a statutory
declaration.
(5) If the holder of
an exploration licence transfers the licence after making an application under
subsection (2) in respect of the licence, the application continues in the
name of the transferee of the licence as if the transferee had made it.
