(1) This section
applies if, while an involuntary inpatient is away from a hospital on leave of
absence, the treating psychiatrist is given a written opinion from another
medical practitioner or a mental health practitioner to the effect that the
involuntary inpatient is no longer in need of an inpatient treatment order.
(2) The treating
psychiatrist must file the opinion as soon as practicable, whether or not the
treating psychiatrist acts under subsection (3) on the basis of the opinion.
(3) The treating
psychiatrist may make an order under section 90(1) in respect of the
involuntary inpatient on the basis of the opinion and without examining the
inpatient.
